Important: This policy forms part of Gingerpot's design submission process. Have a South African lawyer review and customise it before relying on it commercially.
1. Your declaration
By submitting artwork to Gingerpot you confirm that:
- the artwork is original;
- you created it yourself, or you hold all rights and permissions necessary to submit it and to grant the licences below;
- it does not infringe any third-party copyright, trademark, design right, publicity/privacy right, or other intellectual property right; and
- you have authority to enter into this agreement.
2. Ownership
You retain copyright ownership of your artwork. Nothing in this policy assigns copyright or ownership to Gingerpot. Gingerpot receives only the limited rights expressly granted below.
3. Prohibited content
Do not submit logos, trademarks, brand marks, sports teams, celebrity likenesses, movie/TV/game characters, or any other third-party intellectual property unless you have written permission from the rights holder.
4. Rights on submission (before selection)
When you submit artwork, you grant Gingerpot a limited, non-exclusive licence to:
- review and moderate the submission;
- display it on this website and in the voting process for the relevant monthly round; and
- use reasonable excerpts, thumbnails, or previews to promote that voting round.
This submission licence does not allow Gingerpot to print, sell, or commercially produce your design unless it is selected as described below.
5. Licence if your design is selected
If your design is selected as the winning monthly design, you grant Gingerpot a non-exclusive, royalty-free licence to reproduce, print, sell, advertise, and distribute the design on merchandise and in marketing connected to that monthly drop and related promotions.
Because the licence is non-exclusive, you may continue to use your artwork elsewhere, subject to any separate agreements you enter into.
- Territory: South Africa and any other territory where Gingerpot offers or sells the relevant merchandise.
- Duration: for the relevant monthly production run and reasonable follow-on promotional use (for example archive pages, social media, customer communications, and portfolio references to past drops).
6. Indemnity
You agree to indemnify and hold Gingerpot harmless from claims, damages, losses, and costs (including reasonable legal fees) arising from your submission or from any allegation that your artwork infringes third-party rights.
7. Moderation & removal
Gingerpot may reject, remove, or halt production of any design at any time, including after a rights complaint or if a design no longer meets our standards.
8. Report infringement
Rights holders may report suspected infringement via the contact details published on this site. Include proof of ownership, a link or description of the material, and your contact information.
